The California Senate will consider SB 9 and SB 10 this week.  Please help us stop this legislation that creates serious issues in single-family residential communities. Contact your Senator today and urge them to VOTE NO on SB 9 and SB 10.

ABOUT SB 9 and SB10

SB 9 and SB 10 would create serious issues in single-family residential communities. Local governments support the building of planned use developments (PUD) because the association is responsible for the upkeep of essential infrastructure, like roads, lights, water, and sewage.

Currently, more than 13 million Californians live in 55,000 associations throughout the state. This bill will negatively impact every one of them!

Here’s why we are asking Senators to oppose SB 9 (Atkins) and SB 10 (Wiener):

  1. SB 9 & SB 10 will create major issues for associations because these developments are designed to support the number of units provided for in the initial local government approved plans.
  2. Increasing the number of residents in a planned community beyond the initial design will strain infrastructure and require upgrades.  The cost of this will be borne by all members of the association, not the individual or entity creating the issue.
  3. SB 9 & SB 10 will create a conflict with assessment allocation provisions in governing documents forcing them to amend these documents every time there is a subdivision of a lot.

  4. Exempting Associations from the provision of SB 9 is appropriate in light of the unintended consequences the bill would create for those who now reside in these communities.
